COLUMBUS, Ohio -- The Ohio Supreme Court ruled Thursday that the state's sale of a prison did not violate the Ohio Constitution. In a 5-2 decision, the court found that authorizing the sale in the state's budget bill did not violate the single-subject rule in the constitution, nor did it involve the state joining with a private entity in a business. The court also held that it did not have the authority to determine if employees who worked at the privatized prison were public employees under state law. That decision must be made by the State Employee Relations Board. The case arose after the state legislature included language in the 2012-13 budget that allowed for sale of up to six prisons. The state ended up selling one -- the Lake Erie Correctional Facility in Ashtabula County -- to the Corrections Corporation of America for nearly $73 million. It also agreed to pay CCA $3.8 million a year to handle Ohio inmates. Read More. |
