Oceanside Gang Members Face Injunction, Must Avoid Two Neighborhood Safety Zones

San Diego County District Attorney Bonnie M. Dumanis, San Diego County Supervisor Bill Horn and Oceanside Police Chief Frank McCoy announced today that a renewed gang injunction has been approved by a Superior Court Judge in Vista. The Preliminary Injunction is against about 50 members of a street gang operating in the City of Oceanside.

“This latest gang injunction will make Oceanside safer for law-abiding citizens who are being harassed, intimidated and victimized by gang members on a regular basis,” said DA Dumanis. “It’s proven that crime goes down when we get these injunctions, and we will continue to use this legal strategy in our fight against gang violence.”

Today’s order prohibits certain activities within two designated “Safety Zones” in Oceanside. The key provisions of the injunction prohibit defendants from associating with other gang members, wearing gang colors, or flashing gang hand signs. Other provisions prohibit activities which are already illegal, such as drinking alcohol or using drugs in public, possessing weapons, trespassing, and graffiti. Violating the injunction can result in criminal prosecution resulting in a $1,000 fine and up to six months in jail.

“For years, a coordinated law enforcement effort has kept the pressure on North County street gangs,” said Supervisor Bill Horn. “I commend the District Attorney, the Oceanside Police Department and the Superior Court for this renewed gang injunction, designating two neighborhood ‘safety zones’ in Oceanside. Our streets belong to law-abiding citizens and these injunctions are one way to keep violent gangs in check.”

Gang injunctions have been used successfully by the District Attorney’s Office since 1997. The injunctions were filed following complaints from residents about gang activities in their neighborhood. Residents told the Oceanside Police Department and the District Attorney’s Office that they did not feel safe.

SAFETY ZONE ONE: Begins at the territory bounded to the north by Mission Ave. from Horne St. to I-5; to the south by Missouri Ave.; to the east by I-5 and extending along Division St. across I-5 to the east curb line of Country Club Lane. Continue north on Country Club Lane to Maxson St., including the apartment complex at 201 Country Club Lane; to the west by Horne St., and extending 100 yards to the outside of each of those boundary streets.

SAFETY ZONE TWO: Starts at SR-76 from I-5 to a perpendicular line through an undeveloped area from the 800 block of Carey Rd. (north boundary). From the perpendicular line through an undeveloped area from SR-76 to the 800 block of Carey Rd. southbound to the 100 block of Carey Rd. at the intersection of Canyon Dr. (east boundary). From the intersection of Carey Rd. and Canyon Dr. north to the intersection of Canyon Dr. and 2000 block of Mission Ave. West from the 2000 block of Mission Ave. to the 1000 block of Mission Ave. to the intersection of Mission Ave. and Horne St. (south boundary). North from the 200 block of Horne St. to the 1000 block of Civic Center (west boundary). From the 1000 block of Civic Center east to the freeway overpass at I-5. From the freeway overpass at I-5 and Civic Center north to SR-76 and extending 100 yards to the outside of each of those boundary streets. The “POSOLE SAFETY ZONES” include both sides of the streets listed above, as well as any alleys, blocks, driveways, parking lots, structures, and businesses located thereon. Also, any canyons within these boundaries are included in the “POSOLE SAFETY ZONES.”
