OR Killers Get Death Penalty, Appeals Begin |

As bank bombers and killers Bruce and Joshua Turnidge head to death row, state attorneys will begin a lengthy series of appeals. A sentence of death is automatically reviewed by the Oregon Supreme Court. If the court finds that a defendant did not receive a fair trial or sentencing, the court sends the case back to the trial court, said Kathryn Aylward, director of the contract and business services division of the Oregon Office of Public Defense Services. A death sentence appeal costs an estimated $85,000, Aylward said. "We're now projecting that a typical direct appeal will take about 700 hours," said Tony Green, a spokesman for the Oregon Department of Justice. The case can be remanded to the trial court multiple times, making it a costly and long process. Another piece of the appeals process is post-conviction relief, a trial-level civil proceeding that often addresses concerns of quality of legal representation, according to state officials.
