Widener professor weighs in on inmate suicide case

A Delaware family's lawsuit is moving forward against two state Department of Correction officials in an inmate's suicide.

The 3rd U.S. Circuit Court of Appeals ruled in a 2-1 decision on September 5th that the wife and children of Christopher Barkes can sue the former correction officials. Barkes committed suicide at Howard Young in November 2004. The lawsuit alleges corrections officials failed to properly screen inmates for mental health.

Widener University School of Law professor John Culhane says the courts will likely look at the specific conduct of the corrections officers. The U.S. Supreme Court has previously said you can't hold someone responsible simply because they are a supervisor.
