| Prank Leads to Jail Time for DJ |

A disc jockey who roamed a neighborhood dressed as a prison inmate during an on-air prank will soon don a real orange jumpsuit. Joseph Lopez, 28, was sentenced to 45 days in jail after he and Graham Herbert, a 19-year-old intern, were arrested in August for going door-to-door asking Millbrae residents to cut off their handcuffs. Both were charged with falsely causing an emergency to be reported, a misdemeanor. It wasn't until police arrived with guns drawn that the duo from KYLD-FM admitted they were performing an on-air stunt. 'This is not about a sense of humor. This is about a completely dangerous situation, and we're just lucky no one was hurt,' said Deputy District Attorney Jennifer Ow. Superior Court Commissioner Jonathan P. Jones sentenced Lopez on Friday after he pleaded no contest. Lopez also was ordered to pay $1,000 in restitution to Millbrae police. Herbert pleaded no contest in November to disturbing the peace, a lesser misdemeanor charge, and was sentenced to a year of probation. The two also have been sued by families who were victims of the stunt. 'It's a very expensive prank, in terms of Mr. Lopez's freedom, and unfortunately, the courts in San Mateo County lack the sense of humor one would expect,' said Lopez's attorney, Kenneth H. Wine. |
