Ohio Execution Delayed

Condemned killer Jay D. Scott came within less than an hour of death last night when the Ohio Supreme Court interrupted his scheduled execution.
The state's highest court granted a delay requested by the 8th District Court of Appeals in Cleveland, which asked for time to consider arguments by Scott's attorneys that the inmate is mentally incompetent to face execution.
The delay puts off the execution indefinitely.
'We're all very pleased and grateful to the Ohio Supreme Court and grateful to the staff at Lucasville,'' said John S. Pyle, one of Scott's attorneys.
Scott spent yesterday preparing for his death, speaking to family members and ordering his last meal at the Southern Ohio Correctional Facility in Lucasville.
The 48-year-old Cleveland man was scheduled to be strapped to a gurney at 9 p.m. and face lethal injection when the Supreme Court granted the delay.
'He's very pleased,'' Pyle said. "He sighed, took a deep breath and said, `Thank you.' ''
Officials representing the state expressed disappointment in the court ruling.
'We regret that the courts have permitted last-minute motions that could have been decided months ago to once again delay the system,'' Ohio Attorney General Betty Montgomery said in a written statement.
