Illinois State Senate OKs Expanded Death Penalty

Despite Illinois Gov. George Ryan's self-imposed moratorium on executions, the State Senate approved a proposal last week that could ultimately add more people to Death Row by strengthening the penalty for gang-related murders. 
The legislation now goes back to the House, which passed a stronger version of the bill in March. The House is expected to endorse the Senate changes and send the measure to Ryan's desk, where its fate is unclear. 
Despite a lopsided 44-9 vote in the Senate, the measure triggered passionate debate over how best to crack down on those responsible for much of Chicago's street violence. Critics of the bill argued that it was too extreme even for politicians wanting to portray themselves as tough on crime. 
The legislation would allow death sentences to be handed to people convicted of murder if their crime was committed while engaging in gang activity. Initially, the proposal called for death sentences for any gang member convicted of murder, but it was toned down to meet constitutional concerns. 
Illinois already has 20 'aggravating factors' that can make convicted killers automatically eligible for the death penalty. The legislation would add gang activity to the list. 
Death penalty opponents said they have launched a drive to persuade Ryan to veto the bill. The legislation now moves to the House, where the stricter previous version passed by a wide margin. 
Opponents said the gang legislation would fail to enforce state murder laws equally and only enhance a broken, two-tiered system of justice. Mary Dixon, legislative director for the American Civil Liberties Union in Illinois, said the legislation would increase the racial disparity of those on Death Row.
