Georgia made final preparations for its first execution by injection, three weeks after a court ruled that electrocution violated the state's ban on cruel and unusual punishment. Terry Mincey, who was convicted of the 1982 murder of a Macon convenience store clerk, was scheduled to be executed Thursday night after the state parole board quickly rejected his plea for clemency. The death chamber at the state prison in Jackson, about 50 miles south of Atlanta, was changed to handle lethal injection, after the Georgia Supreme Court's ruling Oct. 5, The electric chair used to put 441 Georgia inmates to death over the past 77 years was replaced by a gurney, upon which Mincey was to be strapped down as technicians insert a needle into his arm to run poison through his veins. Mincey's attorney, Amy Donnella, said she was preparing an appeal to be filed with the Georgia Supreme Court. If that fails, she can ask the U.S. Supreme Court for a stay. 'We have several things that can still be done,' she said Wednesday. Mincey would be the 24th person executed by the state of Georgia since the death penalty was resumed in 1976. Lawyers for Mincey, 41, have argued that his co-defendant, Timothy Jenkins, fired the shot that killed 38-year-old Paulette Riggs during a robbery. Jenkins, who pleaded guilty to armed robbery and aggravated battery, testified for the state against Mincey. Jenkins was released from prison in August 1992. Several anti-death penalty groups have called for the state to spare Mincey, claiming he may have had brain damage that caused him to act irrationally and that his trial jury never heard that evidence. 'The state of Georgia isn't wasting any time killing again,' said Cari Courtney-Quirk of the Campaign to End the Death Penalty. |
