A bailiff at a courthouse in northern Texas fatally shot a convicted bank robber last week when the man tried to grab another bailiff's gun. Courtney Jermaine Bourda was being escorted from the courtroom to a holding area in the Denton County Courts building when he grabbed for Officer Kent McKee's gun and wrestled him to the floor. A second bailiff, Officer Emmett Huschke, fatally shot Bourda in the head with a .45-caliber pistol, Kevin Patton of the Denton County Sheriff's Department said. Bourda, 23, was on trial on charges of kidnapping and assaulting a public servant relating to a 1999 bank robbery. He had already been convicted and sentenced to life in prison for the robbery. Texas Ranger Tracy Murphree said a preliminary investigation shows the shooting was necessary and justified. The jury had just been escorted out of the courtroom for an afternoon break, said Lee Ann Breading, an assistant district attorney who was in her office across from the courtroom. Bourda was not wearing handcuffs. 'Correct procedure was being followed to a T,'' Patton said. 'You cannot let a jury see a defendant in handcuffs, and he was not cuffed.'' Bourda died at the scene, Patton said. |
