| Charges Dismissed in Prison Sex Case |

Charges were thrown out Monday against a prison officer accused of providing inmates with snacks and cigarettes from the commissary in exchange for sexual favors. The law on which the charges were based was unconstitutionally vague and the inmates consented to the sexual contact with officer Eileen Mayfield, Montgomery County Judge Maurino J. Rossanese Jr. said. District Attorney Bruce L. Castor Jr. said he would appeal. ``It seems pretty clear that you just can't have prison officers having sex with inmates,'' Castor said. ``We feel confident that we will be successful on appeal and we look forward to trying this case early next year.'' Mayfield's lawyer, Jeffrey Allen Sigman, said he was pleased with the judge's ``courageous'' decision. He said the alleged incidents never happened. Mayfield, 43, was charged in December 2000 with three counts of institutional sexual assault, a felony assault charge that applies specifically to state and county correctional workers. A officer at the Montgomery County Correctional Facility in Eagleville for about 18 years, she was fired after the allegations. According to court documents, Mayfield was working in the prison commissary between 1998 and 2000 when she provided the inmates with thousands of dollars of stolen items, including cigarettes, food, underwear and postage stamps. The prison is located about 20 miles outside Philadelphia. The prison warden, Lawrence V. Roth Jr., did not return a telephone call. |
