County jails may be full again

OKLAHOMA CITY, Okla. — A new law which takes effect November 1 will require court clerks or sheriffs to notify the Oklahoma Department of Corrections regarding offenders bound for state prison within 3 days of availability.

Prior to HB 1630, there was no specified time frame to send judgment and sentencing paperwork to ODOC. If state prisons are full, sheriffs can negotiate the fee to house state offenders. The bill is expected to provide more accurate offender counts for ODOC and save tax dollars.

ODOC pays for every offender housed in county jails waiting transport to state prisons. In the fiscal year 2014, they paid county jails $22 million, according to a press release from the governor’s office Tuesday. Housing offenders in county jail costs ODOC more than to house them in state prisons, but because the law also allows for fee negotiation, it could lessen the expense for the department.
