| Ohio Man Freed by DNA Evidence Sues State |

A Toledo man who was freed from prison after DNA testing showed that a another man may have raped and killed a woman more than 20 years ago has filed a lawsuit in Lucas County Common Pleas Court against the state of Ohio. Danny Brown claims that he was wrongfully imprisoned for 19 years for the 1981 murder of Bobbie Russell and is entitled to receive compensation. Mr. Brown is not asking for a specific amount. A jury found Mr. Brown guilty in 1982 in the rape and strangulation murder of Ms. Russell. He was convicted largely on the testimony of Jeffery Russell, the then 6-year-old son of the victim. Ms. Russell was found Dec. 5, 1981, in her Birmingham Terrace Apartment. She was strangled with an electrical cord that had been pulled from a nearby Christmas tree. A semen sample taken from the attack on Ms. Russell was matched in 2001 to Sherman Preston, who was convicted in 2000 of the murder of Denise Howell. Miss Howell, who was murdered in 1983, also had been strangled. Preston, who is serving a life sentence, has not been charged in the murder of Ms. Russell. Mr. Brown was released from prison in April, 2001, and the charge was later dismissed by Lucas County Common Pleas Judge Charles Doneghy. However, Prosecutor Julia Bates has said Mr. Brown could be indicted again for the murder of Ms. Russell. |
