Prison Officer Charged With Rape

A Utah State Prison correctional officer was charged October 3 with first-degree felony rape for allegedly sexually assaulting a female inmate at the Draper facility. 
Louis Poleate, 43, allegedly took the 19-year-old woman from her cell on Sept. 17, on the pretext of escorting her to the prison infirmary for medical tests, according to charging documents filed in 3rd District Court. 
The woman claims Poleate instead took her to a gatehouse, a secure area, where he began kissing and fondling her. Despite the woman's pleas to stop, Poleate allegedly pulled open her jumpsuit, pushed her onto the floor and forced her to have sexual intercourse, charging documents said. 
The woman's cellmate told Salt Lake County Sheriff's investigators Poleate had been 'flirting' with the woman during the week leading up to the alleged rape. And the cellmate said the woman was shaking, upset and began to cry when she returned to their cell, according to charges. 
The woman began crying again the next morning, when she told her cellmate about the alleged rape and stated Poleate 'wouldn't get off her and it freaked her out,' charging documents state. The cellmate summoned prison authorities and reported the incident. 
A forensic nurse who examined the woman on Sept. 18 observed abrasions and lacerations on her genitals consistent with 'nonconsensual' penetration, according to charging documents. 
Prison transport records indicate the woman was taken from her cell on Sept. 17 at about 4:15 p.m. and returned at 5:35 p.m. Prison infirmary records show the woman was never taken there that day. 
Corrections Department spokesman Jack Ford said Poleate had been employed about a month and was still on probationary status at the time of the alleged rape. 
Poleate was removed from the women's prison facility immediately after the rape allegations were made on Sept. 18. Later that day, he was placed on administrative leave.
