A Richmond man who was serving time for a rape he didn't commit was returned to prison just four days after DNA evidence cleared him. A judge recently cleared Albert Kent Johnson's record of a 1992 rape he didn't commit. But parole officers miscalculated Johnson's parole date from another rape conviction. They thought it was three years overdue. Instead, they learned Johnson still owes some state time. His parole date is actually July 2003. So, Johnson was re-arrested October 8. The 41-year-old Johnson was serving 39 years for the two convictions. The DNA evidence knocked 24 years off the sentence and 'good time' credits reduced it further. Johnson was taken to a state prison in Tracy. |
