| Attempted Murder Charge Against Texas Inmate Dropped |

Because of problems with a key witness's testimony, Bee County officials have dropped an attempted murder charge against a prison inmate accused of arranging the death of a district judge. Robert E. Lee, 40, has been awaiting trial on the attempted capital murder charge since his indictment in January 2001 by a Bee County grand jury for allegedly conspiring to kill state District Judge Mark Luitjen. The judge was not harmed. Lee pleaded guilty November 4 in Bee County District Court to a lesser charge of attempting to destroy evidence. That felony charge stems from allegations that Lee tried to hire an unidentified person to destroy evidence held in a vault by authorities, prosecutors said. Assistant District Attorney Herb Hancock said the next day that he was ready to go to trial on the attempted capital murder charge, but new evidence raised questions about the testimony that had been provided by Dion Clack. Clack, the brother of San Antonio Express-News columnist Cary Clack, was being held November 5 on unrelated charges. Dion Clack told authorities about the plan. 'This case has been a roller-coaster ride for me and this office,' Hancock said. |
