Rehearing Requested for Tenn. Death Row Inmate

Attorneys for death row inmate Abu-Ali Abdur'Rahman said they filed a petition asking the U.S. Supreme Court to rehear their client's case.
Attorneys Bradley MacLean and William Redick Jr. notified the state Supreme Court of the petition in a filing released yesterday. They want the state court to hold off on setting an execution date because of their pending request to the U.S. Supreme Court.
The Supreme Court heard arguments in Abdur'Rahman's case in November, then dropped the case last month. At issue was whether the condemned inmate's last-minute appeal - claiming that the state didn't turn over evidence as it should have, made misleading statements and improperly prepared witnesses - was filed too late under a federal law that limits death penalty challenges.
Some justices questioned whether the case was properly appealed to the high court. Justice John Paul Stevens disagreed with the dismissal. Despite any procedural problems with the case, he said, it raised issues the court should address.
Abdur'Rahman was sentenced to death for a 1987 knife attack that killed Patrick Daniels and critically injured his girlfriend, Norma Jean Norman.
