A man facing the death penalty in the killing of his estranged wife's lover was inadvertently released from Cook County Jail. Authorities believe Juan Alvarez, 38, fled to his native Mexico after being set free in March. The mistake became public April 16 when a federal warrant was issued for his arrest. Alvarez is suspected of hiring two men to kill Jose Estrada, his estranged wife's boyfriend. Estrada was shot to death on Aug. 13, 2002. Prosecutors said they were going to seek the death penalty in the case. Alvarez was indicted on murder charges last fall, but those charges were superseded in a second indictment. The original indictment was dropped, but the paperwork apparently did not indicate he had been re-indicted. Alvarez was released to immigration officials because he was in the country illegally. They then gave him the option of returning to Mexico, not knowing that he was still facing murder charges. The Cook County Sheriff's Office is investigating why Alvarez was released. 'That hasn't been determined at this point,' Sheriff's spokesman Bill Cunningham said. 'It could be human error or a problem with the process.' |
