| Woman Inmate Testifies About Alleged Prison Rape |

After Louis Poleate 'kissed her all over,' he forced a 19-year-old Utah State Prison inmate, still shackled at the ankles, into a supine position and raped her last year, the woman testified recently in 3rd District Court. The woman, who said she had returned a hug and kiss from Poleate just before the alleged assault, testified that she repeatedly begged the then- correctional officer to stop. 'I was telling him 'no' the whole damn time,' said the woman, who testified in an orange jumpsuit, with her arms and legs shackled. 'I said, 'I don't want to do this, I don't want to do this.'' Following the woman's testimony, 3rd District Judge Sheila McCleve ordered Poleate, 43, to stand trial on a first-degree felony rape charge. If convicted, Poleate, who has been fired by the Department of Corrections, could spend up to life behind bars. Arguing that Poleate should not be bound over for trial, Poleate's attorney, Shawn Robinson, told McCleve that the alleged victim had provided statements to investigators that were inconsistent with her testimony. But the judge dismissed that argument and pointed to a medical report that indicated the woman had suffered trauma in her genital area. 'There is reason to believe that the crime occurred and that you committed it,' McCleve said to Poleate. She scheduled a trial for Feb. 24 in 3rd District Court. |
