Man Imprisoned 21 Years Gets New Trial After DNA Doesn't Match

A North Carolina man imprisoned more than 21 years for rape was granted a new trial after tests showed his DNA did not match evidence from the crime scene.
Leo DeWitt Waters was released from prison on $10,000 bond January 29 after a judge set a new trial for Feb. 24. Defense attorney Mark Raynor was expected to file a motion to have the charges dismissed.
Waters has always maintained his innocence and testified at his 1982 trial that he did not attack the woman. He was sentenced to life in prison.
The new tests showed Waters' DNA did not match evidence recovered from the woman's body or her bedspread after she was assaulted in her Jacksonville home.
