Court Upholds Death Sentence Despite Inmate's Retardation Claims

The Ohio Supreme Court says a Cincinnati man convicted of raping and strangling a six-year-old girl did not prove at his trial that he was mentally retarded. 
The court today unanimously upheld the conviction and death sentence of 53-year-old Ralph Lynch in the 1998 death of Mary Jennifer Love. The execution of Lynch could be years away because he has yet to file his mandatory appeals in federal court. 
Chief Justice Thomas Moyer, writing for the court, says while Lynch's IQ of 72 suggests he is borderline mentally retarded, there was no evidence presented at his trial to back his claim. 
The U.S. Supreme Court last year ruled that it was unconstitutional to execute mentally retarded inmates.
