| Court Rules Death Row Inmate Should Be Re-Sentenced |

A federal appeals court has ruled that a man sentenced to death for a Cleveland slaying should be re-sentenced. The Sixth U.S. Circuit Court of Appeals ruled that 43-year-old death row inmate Wiley Davis should get a new sentencing hearing for the kidnapping and murder of Amy Perkins. Investigators said Perkins was kidnapped in November 1991 from a downtown Cleveland parking lot, shot in the head and left to die. Two appeals judges ruled February 4 that Davis' sentencing was unfair because the jurors could have been confused by a judge's instruction on whether to impose a death or life sentence. In a dissent, a third appeals judge said the court should not have disturbed the death sentence. Davis remains on death row while Ohio's lawyers decide whether to challenge today's ruling. No execution date is pending for him, while his appeals are in the courts. |
