| Calif. Inmate Stabs His Attorney in Courtroom |

Pelican Bay State Prison inmate Phillip Evans stabbed his attorney, Leroy Davies, with a handmade weapon at Del Norte Superior Court on Thursday, but a pen in Davies' pocket prevented penetration of his skin. 'This is compelling evidence that inmates like Mr. Evans are not ready to come back into society and that's why we prosecute them,' District Attorney Mike Riese said. Evans had a release date coming up and was in court for a shackling motion hearing to determine what level of restraint would be required to have him safely in court. Riese said the handmade weapon resembled a 16-penny nail attached to a twine-wrapped handle one half-inch inch in diameter, with an ice-pick type tip. He said the attack did not hurt Davies due to a thick pen in his shirt pocket that blocked the weapon's point. Evans had managed to pick the lock of his handuffs. It took five Department of Corrections officers to subdue Evans. Riese plans to assign a new attorney to defend Evans, interview witnesses and collect evidence before charging the inmate for yesterday's attack. 'It will be assault with a deadly weapon at the very least,' Riese said. According to information from the prison, Evans is currently imprisoned for assault on a prisoner. |
