| Former N.M. Jail Inmate Sues Over Secondhand Smoke |

A former Santa Fe County jail inmate alleges in a lawsuit that he was subjected to cruel and unusual punishment from secondhand smoke in the lockup. Ethan Roberts says he was forced to breathe smoke from the cigarettes of other prisoners. He's sued the jail's former manager, Cornell Corrections, for $1 million in damages. A Cornell spokesman said August 4 he couldn't comment on the lawsuit because he hasn't seen it. Roberts filed the lawsuit last week in state district court in Santa Fe. He was in the jail from April 16, 1999, to June 8, 2000. The lawsuit says he's now an inmate at a federal penitentiary in Big Spring, Texas. |
