Two Kentucky men charged in a six-state crime spree have pleaded innocent to carjacking and kidnapping a former New Hampshire woman who has been missing for nearly two months, authorities said. Branden Basham, 25, and Chadrick Fulks, 21, pleaded innocent Tuesday to federal charges. Police said the men kidnapped Alice Donovan of Galivants Ferry from a Wal-Mart in Conway on Nov. 14. Authorities presume Donovan has died, meaning both men could face the death penalty if convicted. Donovan grew up in Kingston, N.H. Her mother and sister live in Bristol. Police also suspect Fulks and Basham in the Nov. 11 abduction of West Virginia resident Samantha Burns, but no charges have been filed and she remains missing. Both men are being held without bond. Basham is being treated for attention deficit disorder in Columbia, said Billy Monckton, his court-appointed attorney. Details on Fulks' locations aren't being released. The trial is not expected to begin until late spring and could be delayed if Basham undergoes a psychological evaluation, which has become a point of contention. Defense attorneys asked Judge Thomas Rogers on Tuesday not to allow police or prison informants to contact Basham without first notifying them. Rogers said he would consider the request, but indicated he would not grant it in full. ''How do I have the authority to say law enforcement ... can't contact him?'' Rogers said. ''I don't know if I could do that.'' Prosecutors said Basham already has a right not to speak or to ask that his attorneys be present. But defense attorneys said they worry Basham could hurt his own defense if he speaks to police without his attorneys present. About 17 jurisdictions in six states are involved in the investigation. Fulks and Basham escaped in November from the Hopkins County jail in western Kentucky. Fulks was captured in Indiana on Nov. 20. Basham was captured in Kentucky on Nov. 17. |
