Opening statements are set to start in the capital murder trial of prison escapee Donald Newbury. Newbury is charged with the Christmas Eve 2000 killing of officer Aubrey Hawkins during the robbery of an Irving sporting goods store. Newbury pleaded innocent to the charges during a pretrial hearing. Prosecutors secured the death penalty sentence in September against convicted killer George Rivas for his role in the killing. Legal experts say they may need a slightly different game plan to send Newbury to death row. Because there was less publicity about Newbury's criminal history and role in the events, it may make it harder for prosecutors to paint him as an unsympathetic killer. Prosecutors said confessed ringleader Rivas was an un-reformable, lifelong felon who helped lead six other convicts on a December 13th breakout, and then showed no mercy when he repeatedly shot Hawkins and ran over him with a vehicle. |
