| Judge Dismisses Murder Conviction for Wrongly Imprisoned Man |

A New York man wrongly imprisoned for 17 years for a bingo hall murder had his conviction overturned Thursday by a Supreme Court Justice. But Angelo Martinez, 36, will remain in prison until he can convince a federal judge that his 24-year sentence for peddling cocaine while in prison should be reduced. Martinez was sentenced to 25 years to life for the 1985 killing of Rudolph Marasco. In 1989, another man, Charles Rivera, a federal prisoner in the witness protection program, confessed to the killing. Authorities didn't believe Rivera because he failed a lie detector test. Investigators were able to confirm Rivera's account through new evidence, prompting Thursday's hearing. Supreme Court Justice Steven Fisher vacated Martinez' conviction and dismissed the indictment, clearing the way for Martinez' lawyer to seek a reduction in the 24-year drug sentence. Lawyer Mark Potashnick said he believes the drug sentence will be reduced once a federal judge re-evaluates Martinez' true criminal history. Martinez pleaded guilty to the drug charge in 1993. |
