Texas Inmate Accused Of Faking Retardation To Avoid Death

A neuropsychologist in John Paul Penry's third sentencing trial has testified that the convicted killer is an extremely dangerous criminal who is faking mental retardation to avoid the death chamber. 
Gary Mears, a professor of psychology at the University of Texas at Tyler says Penry is a "very dangerous man.' 
After the defense rested Saturday, prosecutors called Mears and other psychologists to the stand to rebut defense experts who testified that dozens of tests show 46-year-old Penry is mentally retarded and brain damaged. The prosecution is trying to convince the jury that Penry should be put to death for the 1979 rape and murder of 22-year-old Pamela Moseley Carpenter in Livingston. 
Prosecutors also want to show that Penry is so dangerous, he could harm prison staff or other inmates if the jury sentences him to life imprisonment. The trial, which began three weeks ago, was moved to Montgomery County because of publicity in Polk County.
