Court to Jailed Penn. Lawyer: Pay or Stay

H. Beatty Chadwick, the Main Line lawyer who has spent seven years in a Delaware County prison cell rather than divulge the location of $2.5 million in disputed assets to his estranged wife, can die in prison if he wants.
That was the substance of a recent ruling by a federal appeals court panel, which said that the only thing keeping the ailing 66-year-old from spending his golden years in freedom is his recalcitrance.
Ailing or not, Chadwick, who has already set the Pennsylvania record for imprisonment on a civil contempt citation and is edging close to the national 10-year record, is not showing any sign of mellowing.
Thomas S. Neuberger, the lawyer for the former socialite and millionaire, said Chadwick would appeal to the U.S. Supreme Court, if necessary.
'The court has held that a wife in divorce court can imprison her husband until he dies,' Neuberger said of the decision by the U.S. Court of Appeals for the Third Circuit. 'This is not Afghanistan. That should not be the law; murderers sometimes serve less time than seven years.'
Neuberger said Chadwick was diagnosed with lymphoma, a form of cancer, a decade ago and has since developed an enlarged prostate.
Albert Momjian, the attorney for Chadwick's estranged wife, Barbara Jean Crowther Chadwick, was not sympathetic: 'Maybe this will get through to him and he'll understand the severity of what he's done to himself.
'He clearly has the ability to comply,' Momjian said. 'No way in the world that he doesn't have the ability. He just doesn't want to share with anybody.'
