Arizona Jail Officer in Beating Case Resigns

A Pima County Jail corrections officer who faced termination - as well as criminal charges - after officials accused him of beating two inmates resigned Tuesday, officials said.
Coe Emmett, 25, did not give a reason for the resignation, said Deputy Nicole Feldt, a spokeswoman for the Pima County Sheriff's Department, which runs the jail. Emmett could not be reached by the Star for comment.
The resignation does not affect the two counts of misdemeanor assault Emmett was charged with on Aug. 19, Feldt said. Those charges stem from July 26 and July 27 attacks, sheriff's officials said.
The incident was the third time a corrections officer has been charged this year with using excessive force against inmates. Officers John Tollett and Don Guarriello were indicted on negligent homicide charges in May and then fired in June when sheriff's officials accused them of beating inmate Douglas Carter, 40, so badly that they cracked three ribs and caused his spleen to rupture.
Investigators said Tollett also inflicted a fatal neck injury to another inmate in December. He was not disciplined or charged because officials agreed with him that that inmate, 74-year-old Karl Budinger, had intimidated officers.
Emmett, who was hired in July 2001 and placed on administrative leave with pay on July 29, was served Friday with a notice that Sheriff Clarence Dupnik intended to fire him. He would have had a chance to contest his firing at a hearing, but the resignation threw out the opportunity, Feldt said.
The termination stemmed from a July 26 incident when Emmett reportedly told a 19-year-old inmate he was going to 'make his life a living hell' if he gave another officer any trouble. Emmett said the inmate tried to attack him, but another corrections officer denied it.
In the other incident, Emmett hit a 35-year-old inmate across the chest.
