| Inmate's Eight Children Sue State |

The eight children of convicted murderer George Marshall have filed a wrongful death lawsuit against the state of California and several San Quentin staff members, including the warden and numerous doctors and physicians. Among its claims, the lawsuit states Marshall did not receive proper medical attention. A trial date is pending. Beginning around Sept. 1, 2000, Marshall made daily requests for doctor's care because of to severe pain, dark urine, rapid weight loss and other symptoms of abdominal distress, according to the civil lawsuit. However, 19 weeks passed before he was admitted to a hospital and diagnosed with terminal liver cancer. Also, Marshall was a diabetic who required two daily insulin injections but often received one shot, and sometimes none, the civil lawsuit claimed. 'We're always getting sued by inmates for some medical reason,' said Russ Heimerich, a spokesman for the state Department of Corrections. 'Some of them have merit and some don't.' He said he could not comment specifically on Marshall's case, because of the lawsuit. 'In general, the inmate population isn't nearly as healthy,' Heimerich said. 'We see a lot of cirrhosis, hepatitis and other illnesses brought on by lifestyle choices. Physically, the average inmate is five to eight years older than the chronological age of his body.' |
