| Mass. Inmates OK'd to Wear Religious Caps |

Prison officials must allow inmates to wear religious caps, even when they are housed in restrictive disciplinary units, the Appeals Court of Massachusetts ruled recently. The court said a prohibition on the wearing of kufis, the bowl-shaped caps worn by Muslims, 'unconstitutionally abridged' the religious rights of Saifullah Abdul-Alazim, an inmate at a Walpole prison. Abdul-Alazim sued state corrections officials in 1998 after his kufi was taken from him when he was transferred to the prison's Departmental Disciplinary Unit for allegedly assaulting a staff member. The state Department of Correction had argued that inmates in the unit should not be allowed to wear kufis because they could be used to hide contraband. The department later said the lawsuit was moot because it had changed its policy and now allows religious head wear, including kufis. The appellate court disagreed, saying prison officials had failed to provide any documentation of the policy change. |
