Charges Dismissed in Abuse Scandal

Charges of beating a fellow inmate in Pennsylvania's Somerset County Jail abuse scandal were dismissed last week for one of the defendants. Shawn Hadix, 27, Friedens, was one of four former inmates charged with beating fellow inmate Richard Ellis as part of a hazing ritual inside the jail Feb. 17, 2005.
Hadix was charged with conspiracy, simple assault, terroristic threats and criminal coercion. Somerset County President Judge John M. Cascio dismissed the charges at a prosecutor's request. Hadix now is housed at State Correctional Institution-Somerset.
At a hearing last year, Ellis testified that Hadix and another former inmate, Randy B. Shipley Jr., approached him on his second day inside the facility and asked him to follow them to a nearby cell.
Once inside the cell, Ellis was given an ultimatum - submit to seven lashings from a hard rubber shower shoe as part of a hazing ritual or suffer a beating. Shipley delivered the first three lashes, according to testimony. The group allegedly threatened Ellis with even more violence if he did not submit to the beating.
During the assault, a third inmate wielded a pipe and advised Ellis, “It's the shoe or the pipe,” police wrote in a probable-cause affidavit.
Shipley, 20, formerly of Johnstown, pleaded guilty to a charge of simple assault, a second-degree misdemeanor that carries a maximum penalty of two years in jail and a $5,000 fine. Conspiracy, criminal coercion and terroristic threats charges were dropped as a result of a plea agreement. Elvis Brown, formerly of Quecreek, also pleaded guilty to simple assault stemming from the incident. A fourth former inmate, Jared Levadnik, 22, of Johnstown, still faces charges.
