A Colorado jury found inmate Clair Lloyd Beazer guilty of third-degree assault instead of the second-degree assault the prosecution hoped for as his trial came to its conclusion last week. The jury started deliberating at 4:20 p.m. and a verdict was reached at 9:02 p.m. Victim William Means was not present for the verdict. "The prosecution is incredibly disappointed with the verdict. A man loses an eye and the jury convicted him of a misdemeanor. I am very disappointed," Deputy District Attorney Kristin Knotts said, citing Beazer's past assault conviction and criminal history. According to Knotts, Beazer could have been facing anywhere from two to 16 years in prison on a felony conviction. In his misdemeanor conviction, Beazer will be facing a possible sentence of up to 18 months in the county jail. Knotts illustrated a similar situation where a jury in 2003 acquitted an inmate charged of assaulting a Sterling correctional officer. The inmate, Jereme Lamberth - also known as Jeremy Schweinhardt -was paroled from the Sterling Correctional Facility two years ago. He appeared in the 13th Judicial District court in 2002 charged of assaulting a correctional officer. He was acquitted in February 2003. Lamberth is now accused of killing 30-year-old Colorado Springs police officer Jared Jensen in February of this year. Jensen apparently was trying to arrest Lamberth in connection to a knife attack when the incident occurred. |
