| Inmate, Two Officers Indicted |

An inmate and two correction officers were indicted Tuesday on charges stemming from an October assault in a New York jail bathroom. The inmate, Kenneth Robinson, slashed a correction officer across the cheek and jaw with a sharpened piece of metal in the bathroom of a housing unit at a Rikers Island jail on Oct. 5, 2005, Bronx prosecutors said in a news release. A second officer, Joseph Collins, of Brooklyn, then punched an inmate who was not involved in the slashing, prosecutors said. Collins later filed a written statement saying that the inmate had threatened him, a claim not substantiated by video evidence, prosecutors said. Authorities said another officer, Nicholas Zito, of Staten Island, disabled a surveillance system so it would not capture images of Collins punching the inmate. Department of Correction Commissioner Martin Horn said cameras are in the jails to protect officers and inmates. "The disabling of the cameras in this instance deprived fellow officers of their best defense against allegations of abuse" and cannot be tolerated, Horn said in a statement released Monday by the Department of Investigation. Robinson was indicted on a charge of aggravated assault on a peace officer. Collins and Zito each face one count of official misconduct. Collins also faces third-degree assault, falsifying business records and other charges. An officer who filed a report about the disturbance without mentioning the punch was charged earlier this year with falsifying business records. An attorney for Robinson, who was jailed for an unrelated crime, did not immediately return a telephone message Tuesday night. A spokesman for the Correction Officers Benevolent Association said the union was defending Collins and Zito. "We do not believe these correction officers did anything wrong, and we will do all that we can to make sure that they are exonerated of these charges," spokesman Michael Skelly said. |
