A Pontiac prison inmate is seeking a new trial in the 1984 murder of a fellow Illinois inmate because one witness recanted, but another witness stuck with his original testimony at a hearing on last week. Stanley Boclair, 48, is serving a life sentence for the murder of fellow inmate Thomas Riley. He is trying to have his case retried because one of three witnesses says he lied. Boclair also hopes new DNA tests will clear him. Witness Craig Chothen, 44 of Chicago, however, testified at a hearing in Livingston County Circuit Court that he saw Boclair kill Riley. The third witness previously repeated his original version of events, saying Boclair killed Riley. Judge Harold Frobish hasn't ruled on whether Boclair will be retried. More evidence is expected to be presented in future hearings over the summer. On Oct. 7, 1984, Boclair and two other inmates attacked Riley to settle a dispute between members of the Gangster Disciples, prosecutors say. Trial testimony revealed the gang's top leader, who was housed at another prison, ordered the attack. Chothen said he saw Boclair stab Riley with some kind of metal object on the cellblock gallery. "I heard 'oh, oh' and saw (Riley) trying to get away and he jumped off the gallery," Chothen said. "Two guys were up there but (Boclair) is who I seen." Riley was stabbed multiple times before he fell over a railing and landed on the floor. Chothen said he risked his own safety to talk about what he saw that day, but he felt a loyalty to Riley, who was a boyhood friend. He said he didn't receive anything for his testimony. Chothen, who served about 10 years in the Illinois prison system for murder, has been out for about 11 years. |
