| ACLU Alleges Crowding in NM Prison |

The American Civil Liberties Union of New Mexico says the state women's prison in Grants has too many inmates, and it wants a judge to force the release of some nonviolent prisoners. State District Judge Jim Hall ruled Wednesday that the state Corrections Department has not complied with the Corrections Population Control Commission Act of 2002. He scheduled an April 18 hearing for the state to show why it should not start releasing inmates who are nearing their scheduled release dates from the New Mexico Women's Facility. The ACLU-NM wants the department to comply with the 2002 law that requires the corrections secretary to convene a special commission when the prison population exceeds capacity for 60 consecutive days. The law requires the secretary to give the commission a list of nonviolent offenders who are within six months of being released. The commission is required to approve people from the list for emergency release to relieve the crowded conditions. Maureen Sanders, legal co-director for the ACLU-NM, said the organization's records show the women's prison has exceeded its capacity of 600 for more than 60 days. The ACLU-NM, in legal papers filed this week, said inmates are being housed at the prison in communal areas that are not meant for long-term custody. The ACLU said that has meant increased tensions and fighting among inmates. |
