While tied to his bed in a Bulloch County (Ga.) jail cell, a fire ignited the mattress and killed Freddie Cheley. Now his family is suing the county. The wrongful death lawsuit claims the jail didn't have adequate firefighting equipment or training for its officers. Cheley, 30, was alone in his cell and restrained to his bunk in March 2002 when his injuries occurred. He later died at an Augusta hospital. Officers at the jail had given Cheley a cigarette a few minutes before the fire to calm him because he had been fighting and screaming, said Elwyn Beddingfield, an attorney for the family. There is no question he was given a cigarette several minutes before (being restrained to his bunk), Beddingfield said. But a lawyer for the county says it's Cheleys own fault that he died. He was alone in that cell. ... The reasonable inference is Mr. Cheley did this himself, said the lead defense attorney, Christopher Balch. The lawsuit alleges that Cheleys death was caused by a lack of a flame-retardant mattress, properly trained personnel, correct monitoring of inmates and appropriate medical aid. |
