| New hope for NC death row inmates |

RALEIGH, NC - The state Senate approved a bill Monday to create a commission that could override a court to free a prisoner. Under the bill, a convicted criminal could petition the eight-member Innocence Commission to look at new evidence that may prove innocence. If five of the eight members agree there is enough evidence, the case would be sent to a panel of three Superior Court judges. Charges would be dismissed if the judges unanimously determined there is "clear and convincing evidence" that the defendant is innocent. A task force recommended the commission formed in part, because of the murder case of Darryl Hunt. He spent 18 years in prison before DNA evidence cleared him of killing a Winston-Salem woman. The bill will go back to the House for concurrence. |
