Minn. Attorney General Mike Hatch says as many as 40 of the most dangerous kind of sexual predators may be on the street or about to go free because the Department of Corrections isn't following the law. Hatch made his claim in a letter to Corrections Commissioner Joan Fabian. Fabian says her department is complying with the law. Under state law, courts may order the most dangerous offenders -- Level Three -- to civil commitment indefinitely. The Corrections Department sends notifications to county attorneys of impending releases, but no longer recommends whether local prosecutors should seek civil commitments. It made the change after coming under criticism for allowing the release of Alfonso Rodriguez Jr., who is charged with kidnapping college student Dru Sjodin. Hatch claims the change violates law, which requires the Corrections Department to make recommendations. Hatch and Fabian are scheduled to meet to air their differences. |
