| Inmate ruled smart enough to die |

WACO, TX - A Waco judge has upheld a convicted murderer's death sentence, ruling that the man isn't mentally retarded and is therefore eligible for the death penalty. Ramiro Rubi Ibarra was convicted in 1997 of the sexual assault and strangling death ten years before of Waco teenager Maria Zuniga. The 52-year-old death row inmate's attorney argued his client has an I-Q of 65. But the only evidence presented was an unsworn report from a Puerto Rican psychologist who isn't licensed to practice in the United States. Read more.
