Former warden sues state for $1M

DES MOINES, IA - Ex-prison warden Russell "Rusty" Rogerson is seeking more than $1 million in a tort claim alleging he was forced to retire prematurely as an institution superintendent and was treated differently than other "at will" employees by the state Department of Corrections.

Rogerson, 55, of Coralville, who served in a variety of posts -- including correctional officer, counselor and warden -- during more than 33 years with the state agency, said he was told by a superior "I needed to offer my retirement or I would be terminated" although he was not given a specific reason for the directive.

Rogerson, in a claim filed with the State Appeal Board, said he had "little choice but to retire even though my career plan was to work until age 62 so that I would receive the maximum IPERS (Iowa Public Employees Retirement System) benefits." He said he was reassigned immediately after submitting his resignation. Read more.
