SACRAMENTO, CA - The state Legislative Counsel has issued a legal opinion saying it is unconstitutional for California to house convicts in private prisons, but the Schwarzenegger administration said the view is flawed because it ignored the fact that the governor has declared an inmate crowding emergency. Written at the request of state Sen. Gloria Romero, D-East Los Angeles, the opinion dated Wednesday said the state constitution limits contracting out state services to "new" functions or to those that "cannot be adequately, satisfactorily or competently performed by civil service employees."
