| N.Y. court opposes order on sex offenders |

ALBANY, NY - New York State's highest court ruled today that the state cannot use mental hygiene laws to confine sex offenders in psychiatric hospitals after their prison terms end. In a 7-0 decision, the Court of Appeals found that state corrections officials had acted wrongly in 2005 when, at the behest of Gov. George E. Pataki, they ordered that 12 sex offenders who were within days or hours of being released from prison be moved to psychiatric hospitals in New York City, without a hearing. The court ordered that the 12 men, who are still confined, be granted an immediate hearing to determine whether they should remain in custody. Read more.
