| Inmate won't testify in smuggling trial |

LEXINGTON, KY - A pivotal defense witness invoked his Fifth Amendment right against self-incrimination and declined to answer questions yesterday during the trial of a guard accused of smuggling drugs into an Eastern Kentucky prison. Alice Marie Stapleton, a correctional officer at the U.S. Penitentiary Big Sandy in Martin County, claims she acted in fear and under duress because an inmate named Kenneth Bates threatened to harm her if she did not bring heroin, marijuana and cell phones into the prison.
