SPOKANE, WA - A federal judge says a Spokane police policy of strip searching suspects in the field without a warrant is unconstitutional. In an order issued this week, US District Judge Robert Whaley says the 2005 strip search of John Burton for drugs was illegal. The ruling means Burton can continue a lawsuit against the city seeking damages. Attorneys representing the city argued Spokane police are given discretion to strip-search suspects in the field.
