MEMPHIS, TN - Prosecutors used recorded jail phone conversations to try to prove that an Oklahoma oilman accused of embezzling millions from a cemetery trust fund is lying when he says he can't afford an attorney. Steve Crossnoe, a county prosecutor, said the recordings show that Clayton Smart instructed his wife, Nancy Smart, to sell property to fund his legal defense. The calls were introduced in a court hearing Wednesday in which a judge granted Smart's request to act as his own lawyer. Read more.
