Federal inmate gets maximum sentence for attacking officers

A federal inmate who attacked two officers will pay the price with an extra 21 years behind bars.
David Earnest, 36, assaulted two correctional officers at the Federal Detention Center in Houston, Texas.
The sentence, imposed by United States District Judge Lee H. Rosenthal is the maximum under the law. Judge Rosenthal ordered that Earnest must serve this 20-plus year sentence only after he has completed the 35-year sentence Earnest is presently serving.
Earnest must also pay $23,191 in restitution to the officers for medical bills and lost time days.
Earnest caused disturbances on three different occasions during May 2003. Each disturbance forced Bureau of Prisons officers to forcibly remove Earnest from his cell.
During the third "force cell extraction" on May 19, 2003, Earnest began assaulting the officers with a pipe as soon as the team entered the cell. Earnest apparently broke the pipe loose from his shower stall to use as a weapon. One of the officers suffered a fractured thumb. The second officer received two lacerations to his right arm causing permanent scars and long-term injury to his wrist and upper arm. Both officers required medical treatment, one needing stitches and physical therapy. A videotape of the May 19 force cell extraction was offered into evidence.
Earnest, who insisted upon representing himself during the trial, testified and attempted to convince the jury that he was acting in self-defense.
Earnest has an extensive past criminal history which includes convictions for aggravated battery, armed robbery, robbery, theft, and conspiracy and possession with intent to distribute crack cocaine.
