| Court: System can refuse to fund [CO's] lawyers |

PENNSYLVANIA - A state appeals court says the state Corrections and Public Welfare departments can decide not to provide defense lawyers or pay the cost of financial judgments against prison guards who engage in criminal or malicious conduct. The ruling overturns an arbitration panel's award to the Pennsylvania State Corrections Officers Association. It also gives the departments' attorneys discretion over when to represent workers accused of wrongdoing. The Commonwealth Court majority says the arbitrators had put the state in a position where it had to defend employees for anything they did at the workplace, including murder. |
