VURGINIA - A federal appeals court hears arguments today in a Virginia inmate's attempt to use the state Freedom of Information Act to obtain public records. Joseph Giarratano is an inmate at Red Onion State Prison. He suffers from hepatitis C and has been unable to obtain a copy of the Department of Corrections' policy describing the protocol for treating his disease. Giarratano is challenging a 1997 state law prohibiting inmates from using the Freedom of Information Act to obtain government documents. The law was intended to curb prisoner abuse of the FOIA law. Giarratano's American Civil Liberties Union lawyers argue that the law violates the equal protection clause of the Constitution. Read more.
