| County sues insurance carrier |

The county has filed a civil complaint in Superior Court against Summit Risk Services, claiming that a contractual agreement required the company to cover a $150,000 settlement with a man who sued the county last year. Thomas D. McCorkle -- who was incarcerated in the Gloucester County jail in late June 1999 -- alleged that corrections officers and medical staff at the prison ignored his requests for medication. McCorkle said that he asked corrections officers and nursing staff for medication on at least two separate occasions, according to the complaint, and that his requests were ignored both times. Shortly after his release from the prison, McCorkle suffered a stroke that allegedly left him with physical disabilities. He later filed a tort claim. Gloucester County claims that Summit Risk -- contracted to provide police with liability insurance coverage on the job -- agreed to provide a defense for the case, which was scheduled to go to trial Nov. 10. However, the suit alleges that counsel supplied by Summit encouraged the freeholders to authorize a $150,000 settlement. According to the complaint, no agreement was reached between the county and Summit as to how much each would contribute to the settlement. Summit paid $50,000. The county paid the remaining $100,000. In the suit, Gloucester County officials claim that the insurance carrier should be held responsible for the entire settlement amount. |
